These Terms of Service (the "Terms") govern your use of the game DEVOUR (the "Game") and this website, both published by Quenvaris Inc ("we", "us", "our"). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.
DEVOUR is a single-player puzzle game. It is a work of fiction with a surgical theme. Nothing in it is medical information, instruction, or advice, and none of it describes any real procedure.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on a device you own or control, for your own non-commercial use. All rights not expressly granted are reserved.
2. What you may not do
- copy, sell, rent, sublicense, or redistribute the Game or any part of it;
- reverse engineer, decompile, or disassemble the Game, except where that restriction is prohibited by applicable law;
- modify the Game, or use a modified client, to alter recorded progress;
- remove or obscure any copyright, trademark, or other proprietary notice;
- use the Game in any way that breaks the law or infringes anyone's rights.
3. Ownership
The Game, including its code, artwork, text, layout generation, sound, and the name DEVOUR, is owned by Quenvaris Inc and protected by copyright and other laws. These Terms do not transfer any ownership to you.
4. Your progress
Your record, achievements, case archive, unlocked instruments and settings are stored on your own device, not on our servers. Deleting the Game, clearing its storage, or resetting or losing the device will erase that progress permanently. We cannot recover or transfer it, because we do not hold a copy. How information is handled is described in our Privacy Policy.
5. Purchases and store terms
If the Game is distributed through the Apple App Store or Google Play, your download and any transaction are also subject to that store's terms, and refunds are handled under that store's policy rather than by us.
6. Updates and availability
We may update, change, or discontinue the Game or any of its features at any time. We may also stop supporting older operating system versions. We do not guarantee that the Game will be available without interruption or free of defects.
7. Disclaimer of warranties
The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, Quenvaris Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost progress, arising out of or relating to the Game. Where liability cannot be excluded, it is limited to the amount you paid for the Game in the twelve months before the claim, or ten US dollars, whichever is greater.
9. Termination
This licence ends automatically if you breach these Terms. You may end it at any time by deleting the Game. Sections 3, 7, 8, and 10 survive termination.
10. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Nothing here removes any mandatory consumer protection you have under the law of your own country of residence.
11. Changes to these Terms
We may revise these Terms. The revised version will be posted on this page with a new "last updated" date, and continuing to use the Game after that means you accept the revision.
